We strive to provide you with choices regarding certain Personal Information uses, particularly around marketing and advertising. Below, you can learn about the various choices and rights you may have about our Personal Information use and disclosure.

Choices from KYOCERA

  • Promotional Offers from the Company. If you do not want us to use your contact information to promote our own products and services or third parties’ products or services, you can opt-out by sending us an email with your request to privacy@da.kyocera.com. You may also opt out of further marketing communications by replying to any promotional email we have sent you or following the opt-out links on that message. This opt out does not apply to information provided to us as a result of a product purchase, warranty registration, product service experience, or other transactions.
  • Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or third parties for promotional purposes, you can send us an email request to privacy@da.kyocera.com or fill out the data request form.
  • Tracking Technologies and Targeted Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this Website may become inaccessible or not function properly. For more information about tracking technologies, please see Cookies and Automatic Information Collection Technologies. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website.
  • Global Privacy Control. We are currently in the process of implementing responsiveness to Global Privacy Control signals in our Website. Please note that this is device-specific and browser-specific. Once fully implemented, we will not send any tracking technologies or cookies if you use Global Privacy Control. If you’d like to exercise any other data rights or would like more information about how our website works with Global Privacy Control, you can send us an email request to privacy@da.kyocera.com or fill out the data request form.
  • Other Do Not Track Signals. Our Website is not designed to respond to “do not track” signals received from browsers.
  • Online Account Holders. You can access, review, and change your Personal Information by logging into the Website and visiting your account profile page. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change or delete information if we believe the change or deletion would violate any law or legal requirement or negatively impact the information’s accuracy. You may also send us an email at privacy@da.kyocera.com to request access to, correct or delete any Personal Information that you have provided to us.
  • User Contributions. If you delete your User Contributions from the Website, including on Amazon.com, we may not control your contributions and copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.
  • State Law Rights.

    California and Virginia residents may have additional Personal Information rights and choices. Please see the State Law Privacy Policy for more information.

    Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to privacy@da.kyocera.com or fill out the data request form.

    Other California Privacy Rights. Additionally, California’s “Shine the Light” law, Civil Code Section 1798.83, permits users of our Website that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. State Law Privacy Policy

In addition to disclosures made elsewhere in this Privacy Policy, California and Virginia laws require businesses to disclose certain information related to our privacy practices. This Section of our Privacy Policy (“State Law Privacy Policy”) serves to comply with the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”) (collectively referred to as “CCPA”), and any terms defined in the CCPA have the same meaning when used in this Section. This Section of our policy also serves to comply with the Virginia Consumer Data Protection Act (“VCDPA”). We use terms consistent with the rest of our Privacy Policy, but note the term the VCDPA uses for ease of reference, where applicable.

Our State Law Privacy Policy supplements the information contained in our Privacy Policy and applies solely to California and Virginia residents.  As with our general Privacy Policy, this State Law Privacy Policy only applies to Personal Information that we collect, use, and disclose as a business, not in our capacity as a service provider or processor.

Reselling Personal Information

The CCPA prohibits a third party from reselling Personal Information unless you have received explicit notice and an opportunity to opt-out of those resales. Third parties that may resell your Personal Information include:

Your State-Specific Rights and Choices

The CCPA and VCDPA provide California and Virginia residents with specific rights regarding their Personal Information, what the VCDPA calls personal data. If applicable, this section describes your CCPA- and VCDPA-based rights and explains how to exercise those rights. The section will not apply, however, if Kyocera does not collect any Personal Information about you or if all of the information we collect is exempt from the statute (for example, the CCPA does not protect information that is already protected by certain other privacy laws, and it does not protect information that is already publicly available; the VCDPA does not apply to Personal Information about a natural person in a commercial or employment context). This Section only includes information Kyocera has collected as a business. It does not address information Kyocera may handle as a service provider for other businesses.

Exercising Your Personal Information Rights

To exercise any state rights described in this Section, please submit a request by either:

Only you, or sometimes someone legally authorized to act on your behalf, may submit a request to exercise your Personal Information rights.

You or your authorized agent may be limited to submit certain requests within a 12-month period. Your request must:

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  • Provide sufficient information, which will likely need to match information we previously collected from you, that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative (“Authorized Agent”). In some instances, we may ask you to provide a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request. For requests seeking particularly sensitive information, we may require additional proof of identification.

If you would like, you may designate an Authorized Agent to make a request under the CCPA or VCDPA on your behalf. We will deny requests from agents that do not submit proof of authorization from you.  If you designate an Authorized Agent to make a request under the CCPA or VCDPA, to verify that an authorized agent has authority to act for you, we may require:

  • A copy of a power of attorney or require that you provide the authorized agent with written permission.
  • You to verify your own identity with us directly.

We will only use Personal Information provided in such a request to verify the requestor’s identity or authority to make it, except for record-keeping purposes. We will delete this information as soon as practicable after complying with the request.

If you submit a request to Kyocera and Kyocera is the service provider or processor of your Personal Information, we will do our best to route the request to the proper party so long as we have sufficient information to do so on your behalf.

Right to Know and Data Portability/Right of Access

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months (the “Right to Know”). Virginia consumers have the right to confirm whether Kyocera is processing your personal data and to access this personal data (the “Right to Access” and “Right to Data Portability”). Once we receive your request and confirm your identity (see Exercising Your Personal Information Rights), we will disclose to you:

  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose for collecting, selling, or sharing that Personal Information.
  • The categories of third parties to whom we disclose Personal Information.
  • The specific pieces of Personal Information we collected about you in a portable and readily usable format when Kyocera processes the information through automated or searchable means.

Right to Delete

California and Virginia residents have the right to request that we delete any of your Personal Information that you have provided or that we have collected from you and retained, subject to certain exceptions (the “Right to Delete”). Once we receive your request and confirm your identity (see Exercising Your Personal Information Rights), we will review your request and may retain the information is an exemption to the law applies.

Right to Correct Inaccurate Information

If we maintain inaccurate information about you, California and Virginia residents have the right to request correction of that inaccurate Personal Information, taking into account the nature of the Personal Information and the purposes of the Personal Information processing. We will use commercially reasonable efforts to correct this information.

Right to Limit

Kyocera’s use of Sensitive Personal Information falls into one of limited business purposes.  We do not share Sensitive Personal Information for any other purpose.

Right to Opt-In or Opt-Out of Sale

The VCDPA gives consumers the right to request to opt out of the processing of the personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. The CCPA has similar opt-out rights.

California consumers also have the right to opt-out of sales or sharing for targeted advertising purposes.

If you are age 16 or older, you have the right to direct us to not sell your Personal Information at any time (the “right to opt-out”). We do not sell the Personal Information of consumers we actually know are less than 16 years old, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 15 years old, or the parent or guardian of a consumer less than 13 years old. Consumers who opt-in to Personal Information sales may opt-out of future sales at any time.

To exercise the right to opt-out, you (or your authorized representative) may send us an email request to privacy@da.kyocera.com or fill out the data request form.

Once you make an opt-out request, we will wait at least 12 months before asking you to reauthorize Personal Information sales. However, you may change your mind and opt back in to Personal Information sales at any time by submitting a request online through this link.

You do not need to create an account with us to exercise your opt-out rights.

Non-Discrimination

We will not discriminate against you for exercising any of your state law privacy rights. Unless permitted by the CCPA or the VCDPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA or VCDPA that can result in different prices, rates, or quality levels, such as offering coupons, discounts, promotions, other price reductions, or promotional offers for products and services in exchange for providing your Personal Information. Any CCPA- or VCDPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. Do not provide your Personal Information if you do not want to opt in to these offers. After you receive a promotional offer, you may opt-out by contacting us. Response Timing and Format

We will confirm receipt of your request within 10 business days. If you do not receive confirmation within the 10-day timeframe, please contact privacy@da.kyocera.com.

We endeavor to substantively respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
